These Terms and Conditions constitute a legally binding agreement governing the use of the Ncart platform by restaurants and end users. By using the platform, you acknowledge and agree unconditionally to all terms stated below.
1. Definitions
Ncart: An integrated technology platform for managing restaurants, orders, delivery, Point of Sale (POS), and Enterprise Resource Planning (ERP) systems.
Restaurant / Business User: Any commercial entity using the platform to manage its operations.
End User: Any individual placing orders through restaurants using the Ncart platform.
Services: All current and future systems and features.
Third Party: Any external service provider integrated with the platform.
2. Scope of Application
These Terms apply to all users globally and from any location, without geographical limitation.
3. Acceptance and Legal Binding
Creating an account or using the platform constitutes explicit and legally binding acceptance of these Terms without reservation.
4. Nature of Ncart’s Role
Ncart is a technology platform provider only and is not:
- A food seller.
- A delivery company.
- A medical or nutrition authority.
- An accounting or tax entity.
Ncart is not a party to any contractual relationship between restaurants and end users.
5. Accounts and Security
The restaurant bears full responsibility for:
- Accuracy of data.
- Account security
- User management.
Ncart shall not be liable for misuse or negligence.
6. Orders, Food, and Delivery
The restaurant is solely responsible for:
- Food quality and safety.
- Compliance with health regulations.
- Pricing and offers.
- Delivery and delivery times.
Ncart bears no liability in this regard.
7. End Users
The contractual relationship exists directly between the restaurant and the end user.
Ncart is not responsible for:
- Customer complaints
- Disputes.
- Refunds or compensation.
- Health or financial damages.
Ncart bears no liability in this regard.
8. Nutrition Services Disclaimer
All nutrition information displayed is:
- Indicative only.
- Not intended for medical use.
- Refunds or compensation.
- Health or financial damages.
Ncart does not provide medical or dietary advice.
The restaurant and end user bear full responsibility for dietary decisions.
9. POS, ERP, and Reports
Reports rely on data entered by restaurants.
Ncart is not responsible for:
- Accounting errors
- Management decisions.
- Financial losses.
10. Third-Party Services
Use of third-party services is at the user’s own risk.
Ncart is not responsible for:
- Payment failures
- Service outages.
- Data loss.
- Third-party disputes.
11. Indemnification
The restaurant agrees to indemnify and hold Ncart harmless from any legal claims, damages, or losses.

12. Subscriptions and Pricing
Subscriptions may be monthly or annual.
Ncart reserves the right to modify pricing upon notification via email.
Continued use constitutes acceptance.
13. Amendments
Ncart may amend these Terms at any time.
Users will be notified via email.
Failure to object within seven (7) days constitutes final acceptance.
14. Suspension or Termination
Ncart may suspend accounts for non-payment or violation after electronic notice and a 48-hour grace period.
In cases of repeated violations or serious misuse threatening system security, Ncart may terminate service immediately without prior notice.
15. Disclaimer
The platform is provided “as is” without warranties.
Ncart is not liable for indirect damages, data loss, or service interruption.
16. Limitation of Liability
Ncart’s total liability shall not exceed the subscription fees paid during the last three (3) months.
17. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Kingdom of Bahrain
Any dispute shall first be attempted to be resolved amicably within thirty (30) days.
Failing such resolution, exclusive jurisdiction shall lie with the competent courts of Kingdom of Bahrain.
18. Data Protection Clause
The platform applies reasonable commercial efforts to protect stored data.
The restaurant acts as the Data Controller, while Ncart acts solely as the Data Processor.
The restaurant is responsible for obtaining all required user consents.
Ncart shall not be liable for data breaches resulting from user negligence.
19. Final Clause
The restaurant and user acknowledge that use of the platform is at their own legal, commercial, and financial risk, and Ncart is fully indemnified from any current or future liability.
Privacy Policy – Ncart

Ncart is committed to protecting the privacy and security of the personal data of all its users. By using the service, you expressly agree to the practices described in this Privacy Policy.
1. Scope of Application & Governing Law
This Privacy Policy applies to all users globally and from any location, without geographical limitation.
Governing Law: This Policy shall be governed by and construed in accordance with the laws of the Kingdon of Bahrain.

We collect only the data necessary to provide our services, including:

Nutrition information is entered exclusively by restaurants and is not reviewed by Ncart.
Ncart is not a medical entity and bears no responsibility for dietary decisions.
Restaurants are fully responsible for the accuracy of nutrition data.
4. Data Sharing with Third Parties
We may share data with delivery partners, payment providers, and hosting services as necessary.
Ncart is not responsible for third-party privacy practices.
5. Data Security & User Rights
We apply reasonable security measures but cannot guarantee absolute protection.
Users may request access, correction, or deletion of their data unless legally required to retain it.
6. Changes to This Policy
Ncart may update this policy at any time.
Updates will be communicated via email or in-app notification.
Changes take effect after seven (7) business days.
7. Limitation of Liability
Ncart is not liable for indirect damages.
Total liability shall not exceed payments made in the last three (3) months.
